U.S. lifts ban on ULA buying Russian rocket engines

A federal judge has lifted a ban preventing the United Launch Alliance from buying Russian-made rocket engines because of U.S. sanctions imposed due to the crisis in Ukraine.
The U.S. Department of State and lawyers for the U.S. Treasury Department’s foreign asset control both told the court in a May 8 hearing that the Centennial-based rocket company’s purchases of engines made by NPO Energomash, a Russian company, doesn’t violate U.S. sanctions.
U.S. Court of Federal Claims Judge Susan Braden, on April 30, issued the temporary injunction against the purchases after concluding that U.S. sanctions specifically block U.S. businesses from dealings with the interests and property of Dmitry Rogozin, Russian Deputy Prime Minister, who oversees his nation’s space program and defense industries.
ULA buys rocket engines for its Atlas V rockets from RD Amross, which is a U.S. joint venture with Russia’s state-controlled space company NPO Energomash.
ULA is joint venture formed in 2006 by merging the rocketry divisions of defense giants Lockheed Martin Corp. (NYSE LMT) and Boeing Co. (NYSE: BA)
The injunction arose out of a lawsuit filed April 28 by Space Exploration Technologies Corp., or SpaceX, seeking to nullify a multi-billion dollar U.S. Air Force contract awarded to ULA in late 2013 for 36 rockets for space launches.
In response to the lifting of the injunction, ULA criticized SpaceX’s potential interference with space projects involving Russian space organizations, which include NASA’s purchases of flights for U.S. astronauts to the International Space Station aboard Russia’s Soyuz space capsule.
“SpaceX’s actions are self-serving, irresponsible and have threatened the U.S.’s involvement with the International Space Station and other companies and projects working with Russian State entities,” ULA said. “The fact remains, even today SpaceX is not certified to launch even one mission under the block buy contract – a contract that was authorized and announced more than two years ago, without objection by SpaceX, and is saving the U.S. taxpayers over $4 billion.”
The U.S. departments of state and treasury concluded that “purchases from and payments to NPO Energomash currently do not directly or indirectly contravene” the sanctions order. The U.S. Department of Commerce, also asked by the judge to weigh in, deferred to the judgment of the other two agencies.
The agencies haven’t specifically designated NPO Energomash as being “owned or controlled” by Rogozin, which is what the sanctions require.
Braden asked the government to alert the court if information comes to light that would warrant re-establishing an injunction against ULA’s purchases.
